Meniscus tear injuries are some of the most common injuries I have seen in my Pennsylvania Workers Compensation practice. That is not all that surprising given the growth in the warehousing and distribution sector. These types of jobs can frequently lead to knee injuries. What is a meniscus? Each knee has two C-shaped pieces of cartilage that are located between the tibia (shin) and the femur (thigh). The meniscus acts as a cushion to protect the lower part of the…

Sometimes I hear stories from injured workers that their employer ‘blew off’ their injury, or did not want to report the injury, or failed to provide any kind of documentation of a work injury. The next question becomes, why? Why does my employer not want to report a work injury? There are several reasons an employer may not want to report a work injury. First, in some cases, particularly with smaller type employers, the employer may not have workers’ compensation…

Many workers’ compensation cases also end in a settlement, where the injured worker receives a lump sum amount to settle their claim. This is the time of year where I get questions from clients on whether their weekly wage loss checks and their settlement funds are considered taxable income. The answer is NO. Workers’ compensation benefits are not taxable at the federal or…

The huge warehouse being built off Exit 24 of Interstate 81 in Shippensburg looks to be nearing completion. The warehouse is reportedly a Walmart Distribution Center. As you can see by the image below, it is nearing completion. Besides more truck traffic on the Olde Scotland Road and Shippensburg in general, a new large warehouse bring more employees. Hopefully, proper training and safe practice prevail at this new location. Mooney law represents injured workers throughout Pennsylvania. With an office located…
If you have been released to light duty and your employer refuses to accommodate those restrictions, then your workers compensation wage loss benefits will continue. In a claim that is denied, then the potential liability for workers compensation wage loss benefits continues to accrue against the workers compensation insurance carrier, should your claim petition be granted. Not all employers have light duty. That can be frustrating for an injured worker who wishes to get back to work. Many do. Wage…
Why am I receiving medical bills in the mail when I was injured at work? There are several potential answers to that question. Under the Pennsylvania’s Workers’ Compensation Act, most injured workers are entitled to certain benefits. One of those benefits is medical care and treatment. Covered medical treatment can include doctor visits, physical therapy, occupational therapy, work hardening therapy, medication, lab and diagnostic tests, surgery, pain management, rehabilitation services, and more. Additionally, it is important to know that there…
