Realities in a Pennsylvania workers compensation settlement

I have written posts before about the timing of a workers compensation settlement. It’s a personal decision between you and your family.  The topic of this post is --- settlement expectations. There are a few realistic expectations that must be discussed to better help you understand the settlement process. First, just because an injured worker decides they are ready to settle their claim, does not necessarily mean the workers compensation insurance carrier is interested in settling claim. It has to…

Dorney Park cited by OSHA for Safe Worker Conditions

Dorney Park, an amusement park in Allentown, Pennsylvania, has been cited by the Occupational Safety and Health Administration (OSHA) for unsafe working conditions for employees.  More specifically, the citation resulted from the Park failing to protect workers from heat hazards and illness.  A June 9 investigation prompted by the teen's collapse near a food stand fryer revealed that Dorney Park's outdoor and food staff, the majority of whom are seasonally employed teenagers, were exposed to heat hazards during their summer employment,…

Dog bite at work is within Course and Scope of Employment

One of the critical elements of proving a Claim Petition in Pennsylvania Workers Compensation is whether the injury occurred in the course and scope of  employment.   The course and scope element has been heavily litigated over the years and the rules are a bit clearer today.  However, at times, course and scope issues still arise. Recently the Pennsylvania Commonwealth Court addressed the course and scope issue on a dig bite incident that occurred at work.  The facts are quite…

PA to tax injured workers? Really?

I am sure you will not find too many people in Pennsylvania that will argue the fact that Pennsylvania needs to overhaul its antiquated school funding scheme, specifically, the reliance upon property taxes to fund public education.  Property tax reform has befuddled and escaped the Pennsylvania General Assembly for years. I am a property owner, tax payer, and an elected School Board member in Shippensburg.  I get it.  I agree that property tax reform, and more specifically, public school funding,…

To the best of our knowledge, the new Procter & Gamble facility is still hiring and not anywhere near capacity.  The huge new distribution center off the Olde Scotland Road in Franklin County Shippensburg is the largest warehouse int he…
